Nolasco allegedly arranged to sneak a Bluetooth earpiece into his Commercial Learner’s Permit exam.
A Lynn man has been criminally charged in connection with an alleged scheme to fraudulently obtain a commercial learner’s permit, federal prosecutors announced.
Rudy Nolasco, 42, faces one count of fraudulently producing an identification document, the U.S. Attorney’s Office for the District of Massachusetts said in a press release. He appeared in federal court on Oct. 13 and was released on specific conditions.
In November 2021, Nolasco allegedly arranged to sneak a Bluetooth earpiece into his Commercial Learner’s Permit exam, which he had previously taken and failed. The scheme was arranged so his co-conspirator, Frank Castro, could provide him with the exam answers, according to federal prosecutors.
Nolasco allegedly explained the scheme during a meeting with an undercover agent who was wearing a recording device, the U.S. Attorney’s Office said. He allegedly gave specific details about how to pay Castro and how the agent could also cheat on the exam through the scheme.
Castro was convicted of similar charges following a jury trial in January. Four months later, he was sentenced to time served of approximately 23 months in prison.
Nolasco faces up to 15 years in prison, three years of supervised release, and a fine of up to $250,000 for the charge of fraudulently producing an identification document. Attorney information for Nolasco was not immediately available Sunday evening.
