Monday’s decision from the broadcasting regulator lands at a particularly tense moment for ARN and Kyle Sandilands, with the radio host having until tonight to respond to a breach notice issued by his employer.
ACMA has imposed additional licence conditions on ARN Media stations broadcasting the Kyle & Jackie O Show, citing repeated breaches of decency provisions under the Commercial Radio Code of Practice.

The new rules will remain in place for five years and apply to any program hosted by or featuring Kyle Sandilands or Jackie ‘O’ Henderson, landing at a moment when the duo’s long running radio empire appears to be unravelling.
The ruling follows findings of nine separate breaches in 2025 involving explicit and offensive content, including segments discussing pornography, sexual positions and a controversial guessing game where hosts tried to identify staff members by recordings of them urinating.

ACMA Chair Nerida O’Loughlin said ARN had repeatedly failed to keep the show within acceptable broadcast standards.
“To date ARN management have been unwilling or unable to control the content that has gone to air.”
The regulator said it had already taken a range of enforcement actions over earlier breaches between 2019 and 2022, after which ARN introduced additional oversight measures including the appointment of two censors for the program.
Under the new conditions, ARN must now commission an independent audit of its governance and compliance systems, provide the findings to the regulator and implement any recommendations designed to reduce the risk of further breaches.
If the licence conditions are broken again, ACMA now has stronger enforcement tools available including court enforceable undertakings, civil penalties, remedial directions or ultimately suspension or cancellation of the broadcasting licence.

The decision also arrives as the future of the long running breakfast program remains uncertain, with the show currently off air amid an escalating dispute between Sandilands and ARN.
The fallout began after an on air clash between Sandilands and Henderson in February. Henderson subsequently took time away from the program and did not return, leaving Sandilands hosting the show solo.
ARN later issued a surprise statement to the ASX saying Henderson could no longer work with Sandilands. The network then suspended the host, alleging serious misconduct and issuing him with a breach notice.
Henderson has since insisted via her own statement that she did not quit or resign from the program, while Sandilands has rejected the breach claim and says he did nothing wrong, with lawyers now involved on both sides.
Reaction to the ruling has been mixed. Some see it as a long overdue show of strength from a regulator often criticised for lacking teeth, while others question why it has taken this long.
What happens next is unclear, but Sandilands has never been known for backing down quietly.
