Sunjay Kapur estate dispute: Supreme Court halts RIPL board changes during mediation

The Supreme Court on Thursday stepped in to restrain key changes linked to a proposed board meeting of Raghuvanshi Investment Private Limited (RIPL), a stakeholder in the Rs 30,000 crore estate of late businessman Sunjay Kapur amid the ongoing family dispute.

The matter has been filed by Sunjay Kapur’s 80-year-old mother, Rani Kapur, who has sought protection of the RK Family Trust during ongoing court-monitored mediation proceedings.

She has also challenged moves linked to a scheduled board meeting of RIPL and sought to prevent participation by her daughter-in-law Priya Sachdev Kapur and other parties until the mediation process concludes.

During the hearing, a bench led by Justice JB Pardiwala restrained the implementation of agenda items concerning the appointment of independent directors and changes to banking signatories, observing that the status quo should be maintained while mediation is underway.

Making an emotional appeal for resolution, the bench said: “She (Rani Kapur) is an 80-year-old woman. We all came with empty hands, and we have to go with empty hands. All we carry is our souls.”

“There has to be a will to settle the matter. Don’t go before the mediator with a heavy heart just because the court has pushed us. Each one of you try,” he added.

The court also noted arguments from the respondents, including RIPL, that certain board-level changes were being undertaken in line with regulatory requirements.

However, it directed that no action should be taken that could impact the mediation process and asked all parties to maintain restraint and work towards an amicable settlement.

Sunjay Kapur died on June 12 last year after collapsing during a polo match in England. The dispute over his estate has since widened into multiple legal battles.

The children of actor Karisma Kapoor and Sunjay Kapur have also separately challenged the authenticity of his alleged will before the Delhi High Court.
